The hiring of a lawyer is an important decision that should not be based upon advertisements, including slick ads and mailings. 

Neal McShane has been practicing criminal law full time since 1979.  Our firm specializes in criminal law only. Mr. McShane is not a general practitioner, however, we will accept calls in all areas of law and will then refer any non-criminal matters to the appropriate attorney in the area of law required to handle the matter (i.e. personal injury, divorce, etc.)

Our clientele base is strictly by referral/word of mouth.  Our law firm is not an advertising/ marketing/”Ambulance Chaser” type attorney law firm.  We believe strongly and exclusively in referral/”word of mouth” based business.  You will not receive a sleazy advertising “flyer” from our organization in an attempt to lure you into our office nor will you find us with a large sleazy “advertisement” in the yellow pages or on television.  This is a practice being legally utilized by “advertising” lawyers in an attempt to generate business.  Subsequent to an incident involving an arrest, an individual will receive numerous “flyers/advertisements” from attorneys seeking the arrestee’s business/case.  Our firm believes strongly against this practice and believes that the important decision of hiring a lawyers should be done by qualification, expertise, experience, reputation, “word of mouth” referrals, etc.. We will provide the highest level/quality of legal work because we want our clients to refer us business in the future and to return to us for any of their future legal needs.

OUR FEES ARE DONE BY TASK/VALUE BILLING, WE ARE NOT A “FLAT-FEE”/ONE PRICE FITS ALL ATTORNEY.  Our fee/compensation is based upon the following factors, to-wit: the complexity of case, the judge assigned to your case, the prosecutor assigned to your case, number of witnesses, who the arresting officer is and his evaluation of client’s “attitude, politeness & cooperation”, number of legal issues involved in case, the jurisdiction (location) of your court, the time and labor involved, the number and uniqueness of the legal motions/aspects/ issues/tactics/constitutional attack(s) involved in your case, the guilt or innocence of client, whether a constitutional rights/motions are involved, the results obtained, paralegal assistance, time spent and time limitations imposed by this representation, demands by client which require time above and beyond normal, i.e. high maintenance type clients and the reputation, experience and ability of the Law Offices of Neal T. McShane, P.A. in representation of the client in the criminal case, etc. 

The Law Offices of Neal T. McShane, P.A. is comprised of Neal T. McShane, Esquire.    No promises will be made as to the outcome of the case.   Neal T. McShane of the Law Offices of Neal T. McShane, P.A. will exercise his best professional skill in the within matter.  Since criminal matters are adversarial in nature, the undersigned, as an advocate will zealously assert the client’s position under the rules of the adversary system as appropriate.  Since most criminal matters are resolved through a negotiated plea, the Law Offices of Neal T. McShane, P.A., as a negotiator, will, if appropriate, initially seek a result advantageous to the client, which will be consistent with the Law Offices of Neal T. McShane, P.A. being honest, straight-forward, and a strong advocate for the client with the State/Prosecutor and the Judge/Court.  Based on prior experience a very high percentage of all criminal cases have some type of attack that will be made prior to any attempt to negotiate a resolution.  The attacks are almost always made in writing, by way of a legal and/or a constitutional attack/motions, on the case and/or on any evidence which is attackable.

There are generally five separate and distinct levels of representation in our criminal cases.

When representation begins at one level of representation and then proceeds to a higher fee level of representation, then the additional charge/fee is due before the day of your next court date, i.e.:  motions hearing/plea/trial, etc..

You will also be required to pay the necessary expenses separately as these expenses are incurred by The Law Offices of Neal T. McShane, P.A.  These expenses may include but shall not be limited to, deposition costs, long distance phone calls, photocopying, private investigators, polygraph, voice stress analysis, witness fees, expert witness, court reporter fees and expenses, process server fees, facsimile, paralegal services, itemization fee, travel expenses outside of the Central Florida area, and all other expenses The Law Offices of Neal T. McShane, P.A considers reasonably necessary for proper defense in this action.
